A recent article in this Journal argued that insider trading is an unethical practice leading to an inefficiently functioning market. The debate on this topic has primarily pitted ethical defenses of prohibition against economic arguments extolling its allowance. In addition to being incomplete, this approach ignores other unwanted economic effects of prohibition itself and unethical implications of its existence. This article shows that Adam Smith's free market concept, when properly interpreted, provides all the incentive structure necessary for an efficient and (...) ethical marketplace even when insider trading is permitted. With tumultuous changes occurring in the former Soviet Union, a unique opportunity exists to examine the implications of unethical behavior in what is,de facto, a totally unregulated market. Recent legalization of commodity trading in Moscow carried with it no legal structure to ensure swift compliance with contract terms. This paper demonstrates that in the absence of legal remedies, a free marketplace appropriately punishes unethical conduct.

Theories of cyber deterrence are developing rapidly. However, the literature is missing an important ingredient—warfighting for deterrence. This controversial idea, most commonly associated with nuclear strategy during the later stages of the Cold War, affords a number of advantages. It provides enhanced credibility for deterrence, offers means to deal with deterrence failure, improves compliance with the requirements of just war and ultimately ensures that strategy continues to function in the post-deterrence environment. This paper assesses whether a warfighting for deterrence approach (...) is suitable for the cyber domain. In doing so, it challenges the notion that warfighting concepts are unsuitable for operations in cyberspace. To do this, the work constructs a conceptual framework that is then applied to cyber deterrence. It is found that all of the advantages of taking a warfighting stance apply to cyber operations. The paper concludes by constructing a warfighting model for cyber deterrence. This model includes passive and active defences and cross-domain offensive capabilities. The central message of the paper is that a theory of victory must guide the development of cyber deterrence. (shrink)

Abstract During the Cold War sections within the Catholic Church reached an uneasy compromise on the moral validity of nuclear strategy. As an ?interim ethic? the dominant Catholic position accepted the legitimacy of nuclear deterrence, but rejected many of the doctrines that underpinned nuclear strategy at the time. Since the end of the Cold War this position has come under increased scrutiny from within the Church. Some commentators claim that the time has come for the Church to officially jettison any (...) vestiges of the interim ethic and reject nuclear strategy outright on moral grounds. Others argue that the Church's position is unsustainable from a strategic perspective. This paper presents a reappraisal of the Catholic position on nuclear strategy. In particular, the work assesses whether there is any common ground between the Strategic Studies approach to nuclear strategy and the Catholic position. The paper concludes that, with evolution in both perspectives, limited congruence can be expanded to produce a new nuclear strategy that satisfies both strategy and Catholic teaching. (shrink)

ABSTRACTThe objective of this article is to move ethical discourse on military strategy beyond the confines of the established War Convention. This is achieved by utilising the common good, a concept found in political philosophy and theology. The common good acts as a positive organising concept for socio-political activity. With its focus on peace, development and the flourishing of the individual and community, the common good poses a significant challenge to strategy. This article constructs an approach to strategy that is (...) compatible with the common good. Importantly, it does so whilst respecting the pursuit of victory as an indispensable component of strategy’s true nature. Nudging works through dispositions to decide with specific heuristics, and has three component parts. A nudge is a feature of an environment that enables such a disposition; a person is nudged when such a disposition is triggered; and a person performs a nudged action when such a disposition manifests in action. This analysis clarifies an autonomy-based worry about nudging as used in public policy or for private profit: that a person’s ability to reason well is undermined when she is nudged. (...) Reasoning well is a component of self-guidance, which is an aspect of autonomy and so something there is reason to promote, preserve, or respect. However, a person can reason well when she is nudged: Many of these heuristics are good rules to reason with, and she can be flexible with respect to them when she takes there to be a better way to reason. Along the way, this paper uncovers several design specifications for responsible nudging, and discusses open empirical questions. However, nudging’s being compatible with reasoning well crystallizes a distinct worry about manipulation: that nudge designers can rely on nudged people guiding themselves toward the designers’ own ends. Manipulation of this sort exploits one aspect of autonomy (namely, self-guidance) to undermine autonomy in other respects. (shrink)

Appearing in English for the first time, Schelling’s 1842 lectures develop the idea that many philosophical concepts are born of religious-mythological notions.

There are two alternative approaches to accommodating an agent-centered restriction against, say, φ-ing. One approach is to prohibit agents from ever φ-ing. For instance, there could be an absolute prohibition against breaking a promise. The other approach is to require agents both to adopt an end that can be achieved only by their not φ-ing and to give this end priority over that of minimizing overall instances of φ-ing. For instance, each agent could be required both to adopt the end (...) of minimizing their own promise-breakings and to give this end priority over that of minimizing promise-breakings overall. The former is what I’ll call the side-constraint approach, and the latter is what I’ll call the teleological approach. In this chapter, I argue that, when it comes to accommodating restrictions, we should (1) favor the teleological approach over the side-constraint approach, (2) favor an act-consequentialist approach over a non-consequentialist, teleological approach (such as Rossian pluralism), and (3) favor a Kantsequentialist approach over other act-consequentialist approaches, where Kantsequentialism is a version of act-consequentialism that holds that persons are ends-in-themselves who are inherently and unconditionally valuable and are, thus, owed our respect. Contemporary health care often lacks generosity of spirit, even when treatment is most efficient. Too many patients are left unhappy with how they are treated, and too many medical professionals feel estranged from the calling that drew them to medicine. Arthur W. Frank tells the stories of ill people, doctors, and nurses who are restoring generosity to medicine--generosity toward others and to themselves. The Renewal of Generosity evokes medicine as the face-to-face encounter that comes before and after diagnostics, pharmaceuticals, and (...) surgeries.
